It is a body corporate that holds an Australian Financial Services Licence (AFSL) and is responsible for the management and operation of the scheme. The RE acts as both the trustee and the manager of the investors’ interests within the pooled fund. The RE is required to prepare audited annual financial reports and ensure compliance with regulatory obligations. The RE must also hold the property of the registered scheme on trust for the scheme’s members and engage another person to hold the assets of the registered scheme on trust for the scheme’s members. The RE’s duties include acting honestly, exercising care and diligence, and prioritizing the interests of the scheme’s members over its own interests when conflicts arise.
